Constitution, the accused's presence “is a condition of due
process to the extent that a fair and just hearing would be thwarted by his absence, and to that extent only.” United States v. Gagnon,
470 U.S. 522, 526 (1985)
Thus, the Constitution does not guarantee
that a criminal Accused be present at all stages of the trial but
rather only at the “Critical stage[s].” La Crosse v. Kernan, 244 F.3d
702, 707-08 (9th Cir. 2001).
Beginning at 3pm Eastern, the President made a number of phone calls and was then briefed by FBI Director Mueller, Secretary Napolitano, Attorney General Holder, Bill Daley, John Brennan, Jim Messina, Phil Schiliro, Tom Donilon, David Axelrod, Dan Pfeiffer, Alyssa Mastromonaco and a number of other senior white house officials. The President asked Director Mueller to travel to Arizona to personally oversee the coordination of this investigation.
The President left a message for, Governor Jan Brewer, Speaker John Boehner, Representative Eric Cantor, Majority Leader, Representative Nancy Pelosi, Democratic Leader, Representative Steny Hoyer, Democratic Whip, Representative James Clyburn, Assistant Democratic Leader and Representative Ed Pastor to express his deep concern and to update all of them on the latest information.
