Judge Roll, 63 years old, had attended the event Saturday in Tucson to thank Rep. Gabrielle Giffords for signing a letter to Judge Alex Kozinski, the chief judge of the Ninth Circuit, to help convince the court to declare his federal judicial district a judicial emergency due to the high number of immigration cases that were being heard in that district, according to Judge Hawkins. A judicial emergency would put certain new measures in place, such as allowing judges to delay a trial because there were not enough bodies to hear the cases.
"Resources are diminished and misspent, however, and confidence undermined, if there is judicial disregard for the sound and established principles. That judicial disregard is inherent in the opinion of the Court of Appeals for the Ninth Circuit here under review."
"To try to inflame the public on a daily basis, 24 hours a day, seven days a week, has impact on people, especially who are unbalanced personalities to begin with," he said, in a stern lecturing tone.
Dupnik, a friend and political ally of Rep. Gabrielle Giffords, didn't name names. But apparently he wanted to.
Whom did Dupnik have in mind? "We talked about [Rush] Limbaugh and the national press people like Glenn Beck," DeConcini said. "He said, 'You know, I [have to] turn those things on and theydevelop hatred.' "
Though federal and state law enforcement officials said that Giffords was the target of the attack, Roll spoke to the Arizona Republic newspaper in 2009 about death threats he faced while overseeing a controversial immigration case. He told the paper he and his wife had been followed by a security detail for a month. “It was unnerving and invasive. ... By its nature it has to be," Roll told the paper.
