Tomlinson 03-50558/ CR 00-1007. (You referred to this case on your seminar) I have a problem which I seek your assistance. As you are aware the 9th reversed, partly on Blakely/Ameline. (We argued on appeal that albeit def's stipulated via their P/A to a min/max amount of loss, because def's prior counsel was IAC during the plea process, (att wrote a letter to def's stating the total amount of loss could be mitigated at the sent. hrng, thus the amount of loss set forth on P/A was irrelevant) we requested the D/C to conduct and E/H on the amount of loss. The D/C declined, relying on amoutn set forth on P/A. Here lies my problem. After Judge Matz denied def's motion for bail pending appeal and after the 9th also denied, no one received notification of the denial, thus, for the past seven months during the pendency of the appeal def's did not surrender to the BOP. Now, after the 9th vacated def's sentences, the gov has filed an OSC asking the court to revoke def's bonds for failure to surrender. The gov cited no controlling authority to support its position and I spent the day at the law lib trying to find a case which would address this issue. None was found. Do you have any suggestions other than asking the court to exercise common sense - i.e, case vacated, def's falure to surrender was not a volitional act, def' remain eligible for bond pursuant to statute, i.e., pending sentencing.
